Hit and Run Accident
Nearly all of us have been involved in a hit and run accident. HUH? This serious offence happens many times a day in Calgary, and though you weren’t caught, you're probably guilty…
You know those little bumper nudges that happen in parking lots. Pretty cheesy, but if it happens and you don’t leave a note with your particulars on the other vehicle, it qualifies as a hit and run. An accident is defined as ‘contact’ between two vehicles… damage doesn't need to occur. We defend this charge often and at times the tickets are given when the driver had no idea the collision even occurred.
In legalese a "Hit and Run" is called “Fail to Remain at the Scene of an Accident”. Leaving the scene of an accident… at fault or not… is the most serious offence in Alberta’s Traffic Safety Act. The punishment for a hit and run in Alberta is a mandatory court appearance and includes 7 demerits and guarantees you the same insurance premiums as an impaired driving charge.
Talk to someone who’s been busted for impaired driving. Their insurance premiums are at least $3000-$5000/year for at least a three year period.
The lesser version of Fail to Remain at the Scene is Failing to Report an Accident. There are a few ways to commit this offense but the bottom line is that you did not leave a note, or otherwise notify the owner of the vehicle or property that you damaged. This charge carries 3 demerit points BUT your insurance company may still elevate your premiums if this version of the hit and run offense shows up on your record. Not all insurance companies are that ruthless, but horror stories of radical premium increases are certainly out there.
There are many defenses to amend a hit and run accident charge and help protect your insurance premiums. PLEASE make sure you talk to us before you even THINK about just pleading guilty. Why is it so very important to fight your hit and run ticket… or any other traffic ticket for that matter?
